This Website Privacy Policy (“Privacy Policy” or “Policy”) describes our policies regarding the collection, use and disclosure of information received from users of this website, historyforhire.com, and from our emails and our mobile applications (collectively the “Site.”)  References to “you” and “your” refer to you, as a user of the Site.  References to “we,” “us,” “our,” or to “HFH” refer to History For Hire, Inc., a California corporation.  HFH also owns historyforhire.net and historyforhire.org, which are currently connected and resolve to www.historyforhire.com, and are considered part of the “Site.” Information collected on the Site may be used by HFH, our agents and affiliates (collectively, “HFH”) in the manner described below.  This Policy applies only to the Site and does not apply to any third party websites, even if they are accessible through the Site.  We may update this Policy from time to time for any reason. We will notify you of any material changes to our Policy by posting the new Policy on the Site and by updating the “Last Updated” date. You should appropriately review this Policy regularly for any changes.

By using the Site you are consenting to our processing of your information under the terms of this Policy now and as amended by us. "Processing" means using cookies on a computer or using information technology in other ways, including, collecting, storing, handling, managing, deleting, using, assembling, combining, and disclosing information and transferring it to the United States.

YOUR AGREEMENT TO THE TERMS OF THIS PRIVACY POLICY

All activities in which you may engage on the Site are voluntary. You are not required to provide any personal information to us unless you choose to access features on the Site which require the information.  If you do not agree with this Policy, then immediately exit the Site and discontinue using the Site.  If you do not agree with the terms of this Privacy Policy, please do not provide us with personal information, and leave the Site. By using the Site, you agree to this Privacy Policy now and as amended by us.

USE OF SITE BY PERSONS UNDER AGE 18 IS NOT PERMITTED

NOTICE CONCERNING MINORS.  You must be at least age 18 to enter or use the Site.  HFH intends only persons who are 18 years or older to use the Site. We are not a general audience Site.  This Site and our services are directed to the professional entertainment industry audience. None one of our content or services are directed to children under age 18.  If a parent or guardian becomes aware that his or her child has provided us with any personal information without their consent, he or she should contact us at info@historyforhire.com. 

COLLECTION AND USE OF PERSONAL AND GENERAL INFORMATION

COLLECTION OF PERSONAL INFORMATION.  We may collect on the Site certain information called “personal information,” which includes information that pertains to your identity.  You may be required to provide personal information to access or use certain parts of the Site or features of the Site.  If you do not provide the requested personal information, you may not be able to access or use the features of the Site where such information is requested.  We may collect personal information such as, including, but not limited to, your name, street or other address, , country and zip code, and other demographic information, email address, telephone number, billing information such as credit card or debit card number and billing address, unique identifiers such as user name and password, preference and other information such as order history, marketing preferences and cell phone carrier, and location information such as your actual or approximate location.   We may include registration, online surveys, and other online forms that ask users to provide their names, email addresses, and other personal information, as well as the following categories of information:  your IP address, browser type and language, access times, navigational information, and actions you take on the Site.  Personal information is, or may be, collected if and when you register.  Additional personal information may be collected to process transactions or to provide our products and services.

YOUR SHOPPING CART    You may view products to rent from the Site and establish a shopping cart. This Privacy Policy applies to any personal information you provide in connection with any such rental or purchase in the case of damage to or loss of a product.

HFH, its service partners, managers, and operators may release and disclose personal or general information to cooperate with a law enforcement investigation, which may include responding to requests and court orders from jurisdictions outside the United States. HFH cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We may report to law enforcement agencies any activities we believe to be unlawful, as determined in our sole discretion.  Release or disclosure of your personal or general information or data for security purposes, to any person or entity under any circumstances, will be based on a determination made solely by us, exercising our sole discretion, permission for which is expressly provided by you to us under this Policy.

ACCESS TO INFORMATION.  We do not maintain procedures for you to review or request changes to the information we collect about you, except you may request an opt-out as provided below in the “CHOICE/OPT-OUT” section.

ADDITIONAL/OTHER SHARING.  We will share your personal information with third parties in the ways described in this Policy.  We may provide your personal information to companies that help us with our business activities (e.g., Site host, merchant services providers, payment processing providers, processing credit card transactions, Site  vendors, shipping your order, assisting us in Site operations, providing client service, delivering email newsletters and marketing email, etc.) or that assist us in improving our products, content, services or advertising.  These companies may use your personal information to provide these services and products.  We may also share your personal information:  With HFH affiliates; As required by law, such as to comply with a subpoena or similar legal process; When we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request; or for any corporate change including a merger, acquisition or sale of assets.  We may share personal information, general information, and other information with persons or companies who manage or assist in the management of the Site such as site managers, operators, designers, hosting companies, shopping cart vendors, and others (collectively “service partners”).  Our service partners may use your personal information to operate the Site and to deliver their services.  For example, your data may be transferred to Site hosting partners and other parties who assist us in designing and operating the Site, executing services (such as for product delivery), or helping us analyze collected data.  These parties will use your data to carry out the services as agreed with us.  Our Site host does not share website information with its other customers and does not use our Site information for third party marketing.    

CHOICE/OPT-OUT   You may choose to stop receiving newsletters, updates or other marketing emails by following any unsubscribe instructions in these emails, or you may stop the delivery of our future email by replying directly to any email with a request to remove you from the mailing list. If you have previously enabled your computer or mobile device to send us location information, you may be able to opt-out from further allowing us to access such information by changing the settings on your computer or mobile device or by uninstalling the application.

DO NOT TRACK SIGNALS This Site does not currently have the capability to recognize or respond to automated web browser signals, including “Do Not Track” signals.

SECURITY

HFH is very concerned about safeguarding the information that we collect about you including your personal information. We take reasonable administrative, physical and electronic measures designed to protect your information from unauthorized access, use, or disclosure.  However, no method of transmitting information over the Internet or storing information is completely secure. Thus, we cannot guarantee the absolute security of any information.

RISK OF INTERCEPTION   When you provide personal information online there is a risk that third parties may intercept and use that information.  We cannot guarantee the security of any information you disclose online. By using the Site, you acknowledge and agree we do not guarantee the security of any data provided to, or received by us, through the Site and that any personal information, general information, or other data or information received from you through the Site is provided to us at your own risk, which you expressly assume.  Facsimile transmission may generally be considered a more secure method of sending personal information, including credit applications, account and credit card authorizations, other HFH forms, and other personal or sensitive information that you may send us. CONSENT TO TRANSFER AND PROCESS INFORMATION IN THE U.S.A   The Site is operated in the United States. By using the Site, or providing us with any information, you fully understand and consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as protective as those in the country where you reside and/or are a citizen. Your personal information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as comprehensive or protective as those in your jurisdiction. 

  

WEBSITE AREAS BEYOND HFH’S CONTROL – THIRD-PARTY WEBSITES.  The Site may contain links to other websites.  If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm you understand and agree with their policies. Your visits and access to such websites are at your own risk.  Those other sites may send their own cookies to users, collect data, or solicit personal information.  If we link to a website, that is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you.

EFFECTIVE DATE, ACCEPTANCE OF, AND CHANGES TO, THIS PRIVACY POLICY.  This Policy is effective as of May 1, 2020, and will remain in effect except with respect to any of its provisions that are changed in the future, in which case the changes will become effective on the date they are posted on the Site or we otherwise notify you of the changes. We reserve the right to change this Policy at any time. Changes, modifications, additions, or deletions will be effective immediately on their posting to the Site. You should check this Policy periodically as its terms may change from time to time. ADDITIONAL PROVISIONS. If it turns out that a particular part of this Policy is not enforceable, this will not affect any other parts of this Policy, which will remain enforceable..

The laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to the interpretation of this Policy and to any disputes arising out of or relating to this Policy. All claims arising out of or relating to this Policy may be litigated exclusively in the federal or state courts of Los Angeles County, California, U.S.A., and you and HFH consent to personal jurisdiction in those courts. Any claim must be brought individually and not consolidated as part of a group or class action complaint.

HFH may provide you with notices, including those regarding changes to this Policy, by posting or display on the Site, email, other communications through the Site, or regular mail.
